These terms govern your use of VPSFairy's virtual private server hosting, the configurator and checkout at vpsfairy.com, and any related support we provide. By creating an account or completing a checkout, you agree to what is written here. If you are agreeing on behalf of a company, you are confirming you have the authority to bind that company to these terms.
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to open a VPSFairy account. The name, email address, and billing details you provide at checkout must be accurate and current. You are responsible for keeping that information up to date, since it is how we reach you about your server and your billing.
You are responsible for anything that happens through your account or your server, including actions taken by anyone you share access with. Use a strong, unique password, keep your SSH keys and RDP credentials private, and tell us right away at support@vpsfairy.com if you believe your account or a server has been accessed without your permission.
A VPSFairy plan is a virtual private server: a slice of vCPU, RAM, and NVMe storage on either a KVM or a Xen host, reachable with root or Administrator access. You are responsible for everything you install and run on it, the same as you would be with a physical machine you owned. We do not review or approve what you install before you install it.
Root or Administrator access means you can configure, break, or secure the server however you choose. We do not patch, monitor, or manage a server unless you have added managed support as a line item on your plan. Losing your own access credentials, misconfiguring your firewall, or running outdated software are things we can help you recover from, but we are not responsible for preventing them.
Servers may not be used for any of the following:
We investigate abuse reports and may suspend a server pending investigation. Where possible we will try to reach you first, but a server generating active harm to other networks may be suspended immediately, before we are able to reach you.
The vCPU, RAM, and storage you configure are yours to use up to the limits you purchased. Sustained resource use that meaningfully degrades the host for other customers may result in a request to upgrade your plan, add a dedicated resource tier, or move to different hardware. We will always try to talk with you before taking action here rather than acting unilaterally.
Some things you run on your server, such as licensed software, third party APIs, or open source projects, come with their own terms and licenses that are separate from this agreement. You are responsible for complying with those terms. VPSFairy is not a party to your agreements with third parties and is not responsible for their availability, pricing, or behavior.
You are responsible for using your server in a way that complies with the laws that apply to you, including export control and sanctions laws where relevant. We reserve the right to decline or suspend service to individuals or organizations we are legally prohibited from serving.
Monthly plans bill month to month; annual plans bill once per year at the discounted rate shown at checkout. Prices shown in the configurator and at checkout are the actual prices you will be asked to pay, calculated by the same pricing formula everywhere on the site. Payment is completed through PayPal or a supported cryptocurrency, confirmed by a member of our team once received, as described on the checkout page.
You can cancel at any time by emailing support@vpsfairy.com, effective at the end of the current billing period. We do not offer partial month refunds for early cancellation. If we make a billing error on our end, we will correct it and refund the difference.
Automated backups are an optional add-on, not a default. If you have not added backups to your plan, the only copy of your data is the one on your server, and losing it (through a mistake, an attack, or a hardware failure) means it is gone. We strongly encourage keeping your own copies of anything you cannot afford to lose, regardless of whether you have backups with us.
When a server is cancelled or terminated for a terms violation, its disk and any associated backups are deleted after a short grace period. Export anything you need before cancelling. We cannot recover data after that window closes.
We target high availability and publish our actual measured uptime on the About page rather than promising a specific number in this agreement. Extended outages caused by the underlying data center provider are outside our direct control, though we will communicate what we know as we know it. We do not offer a formal service level agreement or automatic service credits at this time.
We may suspend or terminate a server for a confirmed acceptable use violation, non-payment after a reasonable notice period, or activity that puts other customers or our infrastructure at risk. Where the situation allows it, we will contact you first and give you a chance to fix the problem.
The VPSFairy name, logo, and the design and code of vpsfairy.com belong to us. You keep all rights to whatever you build, install, or store on your own server. We do not claim any ownership over your content just because it happens to run on our infrastructure.
VPSFairy is provided as is. We do not promise that the service will be uninterrupted, error free, or suitable for every specific purpose. We work to keep things running well, but we are a small team, not a guarantee of perfection.
To the extent permitted by law, VPSFairy is not liable for indirect, incidental, or consequential damages arising from your use of the service, including lost data, lost revenue, or lost business, except where that data loss was caused by our own gross negligence. Our total liability for any claim is limited to the amount you paid us in the three months before the claim arose.
You agree to cover reasonable costs and damages we incur as a result of your violation of these terms or misuse of your server, including claims brought by third parties because of content or activity on your account.
These terms are governed by the laws of the jurisdiction where VPSFairy is registered to do business, without regard to conflict of law principles. Before either of us files a formal claim, we ask that you first email support@vpsfairy.com so we can try to resolve the issue directly. Most disagreements with a four person company are easier to sort out over email than in court.
We may update these terms as the service changes. Material changes will be noted on this page with an updated date at the top. Continuing to use your server after a change takes effect means you accept the updated terms.
